1. Introduction

Welcome to MoboEV. These Terms & Conditions govern the access and use of the MoboEV platform, website, services, vehicle rental facilities, mobile communication services, and associated systems operated by MoboEV LLP

By registering on the platform, accessing the website, submitting KYC documents, booking a vehicle, making payments, or using any services provided by MoboEV, the user (“Rider”, “Customer”, “User”, or “Renter”) agrees to comply with these Terms & Conditions.

If the user does not agree with any part of these terms, the user must discontinue the use of the platform and services immediately.

2. Nature of Services

MoboEV is a rental platform that provides company-owned electric two-wheelers on rental basis to approved riders.

MoboEV:

  • Owns and manages the electric vehicles provided under rental plans.
  • Approves riders only after successful registration and KYC verification.
  • Provides vehicles under various rental plans subject to availability and approval.
  • Is not an employment provider.
  • Does not guarantee income or delivery opportunities to riders.

The rider is solely responsible for independently using the rented vehicle for lawful purposes.

3. Eligibility

To use MoboEV services, the rider must:

  • Be at least 18 years of age.
  • Possess a valid government-issued Driving License suitable for operating electric two-wheelers.
  • Provide accurate and authentic KYC documentation.
  • Provide valid mobile number and email address.
  • Comply with all applicable laws and traffic regulations.

MoboEV reserves the right to reject, suspend, or terminate any registration without prior notice if any information is found false, misleading, incomplete, or suspicious.

4. Registration & KYC Verification

Users are required to register on the platform and complete KYC verification before becoming eligible for vehicle allotment.

The rider agrees that:

  • Submission of registration does not guarantee approval.
  • KYC verification may include identity verification, address verification, driving license verification, or additional checks.
  • MoboEV may request additional documents at any stage.
  • Fake or forged documents may result in permanent account suspension and legal action.

MoboEV reserves the right to approve or reject applications at its sole discretion.

5. Vehicle Allotment

Vehicle allotment is subject to:

  • Successful KYC verification
  • Availability of vehicles
  • Completion of required payments
  • Acceptance of applicable agreements and policies

MoboEV reserves the right to:

  • Change allotted vehicle models
  • Replace vehicles when necessary
  • Delay allotment due to operational or maintenance reasons
  • Suspend allotment for policy violations

All vehicles remain the sole property of Ants4u International Pvt. Ltd.

6. Rental Plans & Charges

MoboEV provides multiple rental plans which may vary based on:

  • Vehicle category
  • Rental duration
  • Security deposit
  • Operational costs
  • Promotional offers
  • Rider eligibility

The rider acknowledges that:

  • Rental charges may be dynamically updated.
  • Pricing is accessible only to approved and logged-in users.
  • Rental plans may include refundable or non-refundable components.
  • Overdue charges, penalties, repair costs, or additional charges may apply.

All applicable charges shall be visible before payment confirmation.

7. Payments

Payments may be collected digitally through approved payment gateways including Razorpay and other authorized providers.

The rider agrees that:

  • All payments are linked to a Rental ID.
  • The rider is responsible for timely payment of rentals, renewals, penalties, or overdue amounts.
  • Delayed payments may result in suspension, recovery action, or additional penalties.
  • MoboEV does not store complete card or banking credentials on its servers.

Payment confirmation is subject to successful authorization by the payment gateway.

8. Security Deposit

Certain rental plans may require a refundable security deposit.

The deposit may be adjusted against:

  • Vehicle damages
  • Missing accessories
  • Penalties
  • Traffic challans
  • Unpaid dues
  • Repair costs
  • Recovery expenses

Refund timelines may vary depending on inspection and settlement procedures.

9. Rider Responsibilities

The rider agrees to:

  • Use the vehicle responsibly and lawfully.
  • Follow all traffic and safety regulations.
  • Maintain proper charging and handling practices.
  • Keep the vehicle secure.
  • Return the vehicle in acceptable condition.
  • Inform MoboEV immediately in case of accident, theft, breakdown, or legal issue.

The rider shall not:

  • Use the vehicle for illegal activities.
  • Drive under the influence of alcohol or prohibited substances.
  • Tamper with battery systems, GPS, speed governors, wiring, or identification systems.
  • Sub-rent or transfer the vehicle to another person.
  • Modify the vehicle without authorization.

10. Traffic Violations & Legal Liability

The rider shall be fully responsible for:

  • Traffic violations
  • E-challans
  • Parking fines
  • Illegal activities conducted using the rented vehicle
  • Violations committed during the rental period

Any penalties or liabilities imposed by authorities shall be recoverable from the rider.

11. Vehicle Damage & Misconduct

The rider may be held financially liable for:

  • Deliberate damage
  • Negligence
  • Battery misuse
  • Water damage
  • Accidental damages not covered under insurance
  • Missing parts or accessories
  • Unauthorized modifications

MoboEV reserves the right to:

  • Impose penalties
  • Recover repair costs
  • Suspend services
  • Initiate legal proceedings
  • File police complaints where necessary

12. Vehicle Return

The rider must return the vehicle:

  • On or before the agreed return date
  • Along with accessories, charger, and documents provided
  • In reasonable operational condition

Late return may attract additional rental or overdue charges.

Failure to return the vehicle may result in recovery proceedings and legal action.

13. Suspension & Termination

MoboEV may suspend or terminate rider access without prior notice for reasons including:

  • Non-payment
  • Fraudulent activity
  • Fake documentation
  • Unsafe driving behavior
  • Policy violations
  • Criminal misuse
  • Harassment or misconduct

Termination does not waive pending financial liabilities.

14. Refund Policy

Rental charges once utilized may be non-refundable.

Refunds, where applicable, may depend on:

  • Vehicle inspection
  • Damage assessment
  • Outstanding dues
  • Applicable deductions

Refund processing timelines may vary depending on operational procedures and payment gateway processing.

15. Communication Consent

By registering with MoboEV, the rider consents to receive communications through:

  • WhatsApp
  • SMS
  • Phone calls
  • Email
  • Website notifications

Communication may include:

  • OTP verification
  • Vehicle allotment updates
  • Rental reminders
  • Payment alerts
  • Plan expiry notifications
  • Customer support communication
  • Compliance-related updates

The rider may opt out of non-essential promotional communication by contacting customer support.

16. Data Protection

Rider information is handled according to the MoboEV Privacy Policy.

MoboEV implements reasonable administrative and technical safeguards for protecting rider information.

Users may request deletion of their data after discontinuation of services, subject to legal and financial retention obligations.

17. Website Usage Restrictions

Users shall not:

  • Attempt unauthorized access to systems
  • Introduce malware or harmful code
  • Abuse platform functionality
  • Misrepresent identity
  • Use automated systems for scraping or abuse

Violation may result in immediate legal and technical action.

18. Intellectual Property

All content on the MoboEV website including logos, designs, branding, graphics, text, software, and operational systems are the property of Ants4u International Pvt. Ltd.

Unauthorized use, copying, or distribution is prohibited.

19. Limitation of Liability

MoboEV and Ants4u International Pvt. Ltd. shall not be liable for:

  • Rider negligence
  • Loss of income
  • Delivery partner disputes
  • Accidents caused by rider actions
  • Third-party claims
  • Indirect or consequential damages
  • Temporary platform interruptions

The rider uses the vehicle at their own risk, subject to applicable law.

20. Force Majeure

MoboEV shall not be held responsible for delays or service interruptions caused by:

  • Natural disasters
  • Government restrictions
  • Technical failures
  • Power outages
  • Strikes
  • Pandemic situations
  • Events beyond reasonable operational control

21. Changes To Terms

MoboEV reserves the right to modify these Terms & Conditions at any time.

Updated terms may be published on the website and become effective immediately unless otherwise stated.

Continued use of the platform constitutes acceptance of revised terms.

22. Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of India.

Any disputes arising in connection with MoboEV services shall be subject to the jurisdiction of courts located in Delhi, India.
